The Rise of Internal SARs from Staff and How it Affects HR Processes

"It's important not to get caught out" was the advice issued by the ICO back in 2023, but they are still receiving over 15,000 complaints a year relating to subject access requests.

Employers are tripping up again and again when it comes to SARs from staff members, especially where there has been a grievance, disciplinary or absence management procedure.

We want to help you avoid being caught out, so we'll be looking into employee obligations when it comes to staff data and giving you our top tips to avoid any pitfalls.

During the session we will be looking at:

      • Discussing common employment processes (such as grievance, disciplinary and absence management) and how subject access requests interlink and affect those processes.
        • Understanding data protection obligations when handling employee data in the course of the employment relationship (such as health data).
        • Top tips to help protect staff data and establish underlying trust with your staff.

    Sam Hall

    Sam qualified as a solicitor in 2021, while working in a Human Rights and Civil Liberties team. His legal experience includes representing clients in civil claims involving public authorities following breaches of the Data Protection Act 2018 as well as other privacy related claims. Sam enjoys dealing with day-to-day data protection queries as well as conducting on-site training and compliance audits. Outside of work, he enjoys long distance running and buying too many books.

    Jenny Salero

    Jenny qualified as a solicitor in 2012 and joined Judicium as a consultant following her qualification. Her grasp of complex HR queries such as restructuring MATs to operate as efficiently as possible has enabled her rise from a consultant to Team Leader of the HR Advisory Team. Her responsibilities still include dealing with the variety of queries in schools HR as well as supporting the team on a daily basis. Jenny is also an experienced trainer. She runs the training sessions for the NAHT’s HR Essentials Course. In her spare time she likes to participate in park runs as well as get creative with crafts and baking cupcakes.
